Understanding Your Process Options
A Decision That Shapes Your Future.
Choosing the right process for your divorce is the first most important decision you will make for your family's transition plan.
At Winestone Mediation, we focus solely on consensual dispute resolution processes, designed to encourage out-of-court settlements, through preservation of dignity, respect and party self-determination. The result is agreements that are built to last and tailored to your specific family circumstances.

Mediation
Mediation is a structured, confidential process in which a neutral mediator facilitates comprehensive discussions to help the parties reach their own agreements. Unlike litigation, decisions are not made by a judge. Mediation places control squarely in the hands of the people most affected by the outcome.
The mediator’s role is to manage the process, not the result. This includes balancing power dynamics, improving communication, identifying underlying interests, and helping the parties generate and evaluate options. Mediation creates space for thoughtful decision-making, even in emotionally charged situations, and allows for solutions that reflect the unique needs of each family.
One of the primary philosophies of mediation is that people are more likely to reach durable agreements when they feel heard and understood. Drawing on the many successful principles of mediation, skilled mediators leverage techniques that reduce defensiveness, deescalate conflict, and keep discussions productive and future-oriented.
Mediation is especially effective for resolving divorce, custody, parenting, and financial matters in a way that preserves dignity, protects children, and supports healthier post-resolution relationships. Clients are encouraged to consult with independent attorneys for legal advice as needed, ensuring decisions are well-informed without transforming the process into an adversarial one.
Collaborative Family Law
Collaborative Family Law is a team-based settlement process designed for families who want comprehensive professional support while remaining fully committed to resolving matters outside of court. Each party is represented by a collaboratively trained attorney, and the process may include neutral professionals such as financial specialists or mental health professionals to support communication and decision-making.
At the outset, all participants sign a written agreement committing to settlement and agreeing that if the process breaks down and litigation becomes necessary, the collaborative attorneys and neutral professionals must withdraw and cannot participate in court proceedings. This structure aligns incentives and keeps all professionals focused on resolution rather than escalation.
The collaborative process is particularly well-suited for complex financial situations, business interests, or emotionally sensitive matters where additional professional guidance adds clarity and stability. While it typically involves more coordination and higher upfront costs than mediation, many families value the depth of support and the deliberate, respectful pace it provides.
